Order of Dismissal

The Respondent, On Nai Lai, appealed the denial of her application for a daycare license. The Division of Administrative Law Appeals held a hearing on the matter on September 26, 2017. The case was thereafter reassigned to me. Before moving forward, I requested the parties[1] provide a status update as to whether they were still waiting for a decision or, because of the passage of time, the matter was moot, settled, or the parties no longer require a resolution for any other reason. I asked the parties to report by January 3, 2025. Neither party responded.

On January 9, 2025, I issued an order to show cause asking why the appeal should not be dismissed for failure to prosecute. 801 Code Mass. Regs. § 1.01(7)(g)(2). I indicated that failure to reply would result in dismissal. I asked the parties to respond by February 7, 2025. Ms. Nai Lai again did not respond. EEC responded and indicated it had no information that shows Ms. Nai Lai is still seeking a license.

Accordingly, it is hereby ORDERED that the appeal is DISMISSED.

[1]           The Respondent’s daughter participated in the hearing. I therefore sent both the Respondent and her daughter copies of the notice. The letter to the Respondent’s daughter was subsequently returned. There was no other address on file for her.
