Order of Dismissal
Petitioner Luis Ortez appeals from the February 2, 2026, letter from the Massachusetts Teachers’ Retirement System (MTRS) stating that he was not eligible for membership because as an Associate Dean of Students and Associate Dean of Culture at Excel Academy Charter School, he was not in a position as a teacher. Mr. Ortez appealed this denial on March 3, 2026, which was beyond the fifteen-day appeal deadline.
Nonetheless, on March 16, 2026, the Division of Administrative Law Appeals (DALA) issued an Order that required Mr. Ortez to file a pre-hearing memorandum by May 1, 2026. Mr. Ortez failed to do so. DALA then issued an Order to Show Cause, requiring him to state in writing by August 7, 2026, why he did not comply with the deadline. Mr. Ortez failed to respond.
In light of the foregoing, Mr. Ortez’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
