Decision  Paolucci v. State Bd. of Ret., CR-25-0430

Date: 10/02/2026
Organization: Division of Administrative Law Appeals
Docket Number: CR-25-0430
  • Petitioner: Annmarie Paolucci
  • Respondent: State Board of Retirement
  • Administrative Magistrate: Judi Goldberg

Order of Dismissal

Petitioner Annmarie Paolucci appeals from a decision of the State Board of Retirement (SBR) relating to her status as a veteran and her attempt to purchase credit under Chapter 32, the Massachusetts Retirement law, for her military service. The SBR filed a motion for summary decision on August 6, 2025. Ms. Paolucci’s response was due October 29, 2025, but she did not file anything by the deadline. The Division of Administrative Law Appeals (DALA) issued an Order to Show Cause ordering her to respond by May 1, 2026, to explain her failure to respond. Ms. Paolucci responded and set forth her arguments to support her application to purchase service; she explained that she had not understood the legal significance of the deadline and asked DALA to consider her claim on its merits rather than dismiss it on procedural grounds. DALA thereafter issued a Pre-Hearing Order requiring Ms. Paolucci to submit her pre-hearing memorandum by June 30, 2026. When she failed to submit her memorandum by the deadline, the SBR filed a motion to dismiss for failure to prosecute. DALA issued an Order to Show Cause to Ms. Paolucci, ordering her explain by September 11, 2026, why she did not comply with the filing deadline. Ms. Paolucci did not respond.

In light of the foregoing, Ms. Paolucci’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
