Order of Dismissal
Kathleen Perry appealed the Massachusetts Teachers’ Retirement System decision to evaluate a raise she received as an assistant superintendent under the anti-spiking statute. The parties have now settled with the Retirement System acknowledging that the salary payments Ms. Perry received during her last three years of service were all regular compensation.
The Retirement System has moved to dismiss the appeal as resolved. Ms. Perry has assented to the motion. The settlement makes his appeal moot, and I am therefore dismissing it. See 801 CMR 1.01(7)(g)3.
