Decision  Pierre v. State Bd of Ret., CR-26-0072

Date: 09/04/2026
Organization: Division of Administrative Law Appeals
Docket Number: CR-26-0072
  • Petitioner: Jean-Claude Pierre
  • Respondent: State Board of Retirement
  • Administrative Magistrate: Thomas E. Bocian

ORDER OF DISMISSAL

Petitioner Jean-Claude Pierre appeals from the State Board of Retirement’s determination that he could not be deemed his former wife’s beneficiary because they divorced prior to her death.  On May 18, 2026, the Division of Administrative Law Appeals entered an order to show cause why petitioner’s appeal should not be dismissed owing to his failure to submit a prehearing memorandum by April 30, 2026, as previously ordered. Petitioner was given until June 15, 2026 to respond to the show-cause order.  No response was received.

Accordingly, this appeal is dismissed for failure to prosecute.  801 CMR 1.01(7)(g)(3).

Dated: August 28, 2026
