Order of Dismissal

Petitioner Jason Thayer appeals from a decision of the State Board of Retirement (SBR) denying his request for Group 4 classification. The Division of Administrative Law Appeals (DALA) issued a Pre-Hearing Order requiring Mr. Thayer to file a pre-hearing memorandum by May 15, 2026. When he did not file the required memorandum, DALA wrote to him asking whether he intended to have a group of documents that he submitted stand in place of the memorandum. DALA asked him to respond by June 24, 2026. He did not respond. DALA then issued an Order to Show Cause requiring Mr. Thayer to explain in writing by September 10, 2026, why his appeal should not be dismissed for failure to prosecute. Mr. Thayer again did not respond. In light of the foregoing, Mr. Thayer’s appeal is dismissed for failure to prosecute. 801 CMR 1.01(7)(g)(2).
