Order of Dismissal

Petitioner Valente filed an appeal seeking Group 2 classification. On May 14, 2025, the State Board of Retirement moved to dismiss this appeal for failure to prosecute. On May 15, 2025, I sent him an email ordering him to file a response to the Board’s Motion to Dismiss and to submit a pre-hearing memorandum.  I gave him until March 21, 2025 to respond.  No response was received.

Accordingly, this appeal is dismissed for failure to prosecute.  801 CMR 1.01(7)(g)3.
