Decision  Weaver v. State Bd. of Ret., CR-23-0469

Date: 09/12/2025
Organization: Division of Administrative Law Appeals
Docket Number: CR-23-0469
  • Petitioner: Loren Weaver
  • Respondent: State Board of Retirement
  • Administrative Magistrate: Eric Tennen

Order of Dismissal

The Petitioner appealed the State Board of Retirement’s denial of her application to purchase prior creditable service. On February 12, 2025, the Division of Administrative Law Appeals (DALA) gave her an extension of two months to file a status report indicating when she would be able to file a prehearing order. Her response was due April 18, 2025. She did not file a response on that date. Instead, on June 23, 2025, DALA again gave her another extension, asking that she file a status report by July 15, 2025. No status report was filed, nor did she otherwise contact DALA.

I then issued an Order to Show Cause on August 8, 2025 asking for a response by September 5, 2025. I indicated the matter would be dismissed if she failed to provide a valid explanation. No response was received.

Accordingly, it is hereby ordered the appeal is dismissed for failure to prosecute.

Eric Tennen
