  1. What to Know

    • MassDEP requires notification ten (10) working days before work begins on construction or demolition of a building, excluding residential buildings with fewer than 20 units.
    • Under the federal emission standards for asbestos, the U.S. Environmental Protection Agency (EPA) also requires notification before work begins on demolition of a building, excluding residential buildings with fewer than four (4) units.
    • Submitting a notification to MassDEP satisfies both requirements; you do not need to notify EPA, as well.
    • A separate notification needs to be filed with MassDEP for each project.
    • It is important to identify the date on which you plan to start your project. Your waiting period of ten (10) working days starts once you submit your notification.

  3. Submit Your Notification

    If you are a new user, you will need to create an account first. Registration takes less than five minutes.

    When submitting a notification via eDEP, you will pay the fee online using a credit card. “Fee decals” are no longer sold and may not be used to file online.

    eDEP will automatically upload your notification to the MassDEP Asbestos Project Lookup database, which is refreshed every 15 minutes. Use this tool to confirm your submission.

  4. Wait Ten (10) Working Days

    Once you submit your notification, MassDEP will have ten (10) working days to review it.

    You may proceed with your project if the agency does not you before this waiting period is over.

    If MassDEP finds your notification deficient, the agency will order you not to proceed with work and give you 30 calendar days to respond.

    After you submit a corrected or revised notification, MassDEP will have ten (10) working days to:

    • Accept your notification and allow you to proceed with work, or
    • Issue you a "stop" order.

    Should MassDEP not allow you to proceed, you will need to submit a new notification and fee payment for work to be done at the same location.

  5. Start Work or Revise Your Notification

    You may begin construction or demolition work only after the waiting period of ten (10) working days specified by the MassDEP asbestos regulation (310 CMR 7.15) has elapsed. Starting early is a violation and may result in enforcement action, including financial penalties.

    If you are unable to wait ten (10) working days before starting work, you must obtain an emergency waiver of the notification requirement. Contact MassDEP for additional information.

    You must begin work on the “start” date indicated in your notification. If you are unable to do so, you MUST file a notification revision via eDEP. See the instructions for details. There is a $35 fee for each revision.
