Victims and survivors are entitled to certain notifications regarding the status of a defendant while incarcerated. This notification allows victims/survivors to be informed when a defendant is released on bail or an inmate's classification within the prison is changed or he/she is paroled or completes his/her sentence. This is accomplished by completing an application for the Criminal Offender Record Information (CORI). The victim/survivors are notified directly by the Department of Correction. Accordingly, accurate and updated information is critical. In the case of a juvenile defendant, the victim/survivor would complete a Juvenile Offender Notification & Information (JONI) and would then be notified by the Department of Youth Services Victim Services Unit.

In cases where an individual becomes a victim of a sexual assault and the defendant is convicted of the crime, the defendant is required by Massachusetts State Law to register with the Sex Offender Registry Board (SORB) and to be classified by them. The Sex Offender Registry Board allows for any victim or parent/guardian of a child victim to submit a victim impact statement. A victim impact statement affords the victims/survivors an opportunity to have the SORB hear the impact the crime has had on them and their families.

The Victim Advocate associated with the case in which you are a victim, survivor or witness will submit an application on your behalf if you are entitled to be notified of a defendant's release from incarceration. Any questions you have about your status or right to be notified of a defendant's release from incarceration can be addressed to the Victim Advocate by calling the Berkshire District Attorney's Office.
