What you need   for File a foreclosure petition with the Division of Banks

You will need a verified account to file Massachusetts foreclosure petition and foreclosure sale information with the DOB using the Foreclosure Petition Website.

You can only start the online registration filing process after a foreclosure petition (or action) has been brought by the mortgagee under the Soldiers' and Sailors' Civil Relief Act. 

To file foreclosure petition or foreclosure sale information, you will need to log in to the Foreclosure Petition Website and provide:

  • Borrower information
  • Filing entity information
  • Previous loan assignees (if applicable)
  • Right to Cure information or the acceleration date

All financial entities with a benefit or interest in a Massachusetts residential mortgage are required to electronically file all foreclosure petitions and foreclosure sales involving one-to-four family, owner-occupied properties with the DOB.

  1. First time user account registration

    You must register the first time you use the Foreclosure Petition Website. To register as a new user you will need:

    • Mortgage Electronic Registration System (MERS) Org ID, or Federal Tax ID number, or SEC number
    • Entity type
    • Loan holder's name and address
    • Contact name, email and telephone number
    • Submitting party's name, email and telephone number

    To complete your registration as a new user on the Foreclosure Petition Website, follow the below steps:

    1. Click the 'Register' button.
    2. The New User Registration form will open and you will be prompted to enter information about your loan holder organization. All fields with the red asterisk are required fields.
      • Only one individual from the organization will be allowed to set up the company's registration.
    3. Complete the form and click the 'Submit' button located at the bottom of the page. 

    The DOB reviews all new user account information.

    • If your new user account request is approved, your account is activated and a notification email is sent to you. The emails includes your user name.
    • If your new user account request is denied, an email is sent to you explaining the decision.
  2. File your foreclosure petition

    1. Log in to the Foreclosure Petition Website by entering your user name and password. Click the 'Log In' button.
    2. Create a foreclosure petition by clicking on the 'Create Petition' link located in at the top of the page.
    3. Complete the form by filing in each required box.
      1. To navigate between pages use the 'Previous' or 'Next' buttons. 
    4. When complete click the 'Done' button.

    You can complete a petition in one session or save portions and complete it at a later date.

    1. After completing the petition, review the information on the summary page. 
      1. If you need to make changes or edits, click on the 'Back' button.
      2. If the summary page is correct, click the 'Commit Petition' button. If you chose to Commit Petition, the information will be saved and cannot be changed. 
  3. Update foreclosure petition information with foreclosure sale information

    Once a foreclosure sale has been scheduled, the petition file needs to be updated.

    1. Log in to the Foreclosure Petition Website. 
    2. Click 'Search Petitions' located at the top of the page. 
    3. Enter in the petition criteria for your search and click the 'Search' button. 
    4. Once you have located the correct petition file, click the 'View' button. 
    5. Use the 'Next' button until you reach the Foreclosure Sale screen.
      • This screen will not appear if you have not already entered the Right to Cure information. 
    6. Enter the foreclosure sale information (sale date, sold to, sale price, etc.). 
    7. Once the Foreclosure Sale screen is complete, click the 'Submit' button. 
      1. If you need to make changes or edits, click the 'Back' button.
      2. If the summary page is correct, click the 'Commit Petition Sale' button. If you chose to Commit Petition Sale, the information will be saved and cannot be changed.

You must enter foreclosure petition information in the Foreclosure Petition Website within five business days after filing with the Land Court.
