How to request an open enrollment waiver

If a health insurance company refuses to enroll you because you do not have a qualifying life event and it is outside the open enrollment period, you can request an open enrollment waiver to allow you to enroll in health insurance.
The Office of Patient Protection (OPP) will respond to your waiver request within 30 days.

What do I need to do before I can apply for an enrollment waiver?

First, you must apply for health insurance with a health insurance company, insurance broker, or the Health ConnectorIf you are denied enrollment, you will receive a written notice either online or by mail. Once you receive the notice denying enrollment in health insurance, you may request an open enrollment waiver.

Complete all pages of the OPP waiver request form through our secure online formYou will be asked to upload a notice denying enrollment in health insurance.

Please note: At this time OPP may accept mail only through United States Postal Service with no signature of receipt required. Correspondence mailed that requires a signature or uses other delivery services will be returned to sender.

Mail your completed waiver form to:

  1. How do I request a waiver?

    Step 1: Complete the OPP waiver form (you may download the form below);

    Step 2: Attach a copy of your notice denying enrollment; 

    Step 3: Send the waiver form and notice denying enrollment to OPP by mail or by fax.

  2. Once I fill out the enrollment waiver form, how long will it take to get an answer?

    OPP will respond to you within 30 days of receiving your waiver form. If OPP asks you for any additional information, please send it back as quickly as possible.

What does OPP consider when reviewing open enrollment waiver forms?

OPP looks at the reasons you were unable to buy health insurance when enrollment was open.

You may be ineligible for an open enrollment waiver if:

  • Your health insurance was terminated because you did not pay premiums
  • You intentionally missed the open enrollment period

If you do not qualify for an open enrollment waiver, you will need to wait to buy insurance until the next open enrollment period.
