Who we are
The Land Court is a court of limited jurisdiction and is one of seven trial court departments across the Commonwealth. It offers specialized expertise to resolve disputes involving the ownership, development, and use of real property. In addition to exclusive jurisdiction over land registration and confirmation, and tax lien foreclosures, the Land Court also has concurrent jurisdiction over a wide range of real estate-related matters, including zoning and subdivision cases, specific performance of contracts regarding real estate, and petitions for partition of real property.
About Judicial Clerkships at the Land Court
Once a clerkship offer is extended and accepted, each incoming Law Clerk is assigned to work with a specific judge. The Land Court operates on an individual calendar system, with one judge assigned to handle a case from the date of filing the complaint through the final judgment. The Land Court has statewide jurisdiction and does not have regions or rotations. Law Clerks at the Land Court work closely with their assigned judge on all aspects of the Land Court’s proceedings. Duties include preparing memoranda on cases and legal issues, drafting decisions and orders, researching substantive and procedural questions, and attending hearings and trials.
Eligibility
Applicants must have a Juris Doctor degree from a law school as of the start date of their clerkship. Clerks must reside in Massachusetts during the period of the clerkship. (Applicants need not reside in Massachusetts at the time of the application, but will need to reside in the Commonwealth if a position is offered and accepted.)
How to apply
Look for the Law Clerk job posting on the Trial Court’s on-line job posting site and follow the instructions contained in the job posting. The Judicial Clerkship cycle at the Land Court runs for a full year, from the end of August to the next August. Judicial Clerkships are full time paid positions with benefits.
The Law Clerk job posting is typically posted between September and October for the following clerkship cycle, beginning in August of the next year.
