The U.S. Department of Housing and Urban Development (“HUD”) imposes an obligation to affirmatively further fair housing on recipients of certain HUD funding (state, local government, and public housing agency “program participants”), which includes conducting an analysis or assessment of fair housing. DHCD last published an Analysis of Impediments to Fair Housing Choice (“AI”) in January of 2014. Since the publication of the AI, HUD promulgated its Affirmatively Furthering Fair Housing (“AFFH”) Final Rule (80 FR 42272 (July 16, 2015); 24 C.F.R. § 5.150 et seq.). The AFFH rule as originally published requires, inter alia, program participants to submit an Assessment of Fair Housing (“AFH”) in place of an AI. As HUD has yet to finalize an AFH Assessment Tool for states and has generally instructed program participants to comply with AI (pre-AFH) requirements, DHCD updated its AI with assistance from a consultant and input from an AI Advisory Council in addition to other stakeholders and members of the public.
