Introduction and Procedural History of this Appeal

The claimant appeals a decision by a review examiner of the Department of Unemployment Assistance (DUA) to deny the claimant benefits beginning the week ending February 7, 2026. We review, pursuant to our authority under G.L. c. 151A, § 41, and we affirm in part and reverse in part.

On February 10, 2026, the agency determined that the claimant was not entitled to unemployment benefits. The claimant appealed and participated in the hearing. In a decision rendered on March 11, 2026, the review examiner affirmed the agency determination, concluding that the claimant did not have good cause for his failure to attain the Reemployment Services and Eligibility Assessment (RESEA) review by the February 6, 2026, deadline and, thus, was disqualified under G.L. c. 151A, § 25(a), as of the week ending February 7, 2026, and until he attained his RESEA review. The Board accepted the claimant’s application for review. 

Ruling of the Board

After considering the recorded testimony and evidence from the hearing, the review examiner’s decision, and the claimant’s appeal, we conclude that the review examiner’s decision is based on substantial evidence and is free from any error of law affecting substantive rights. However, the DUA has temporarily suspended the imposition of RESEA sanctions beginning the week ending Feb. 28, 2026. In light of this temporary suspension, we are placing an end date of February 21, 2026, on the claimant’s period of disqualification.

We also note that information in the Massachusetts One Stop Employment System (MOSES) shows that the claimant finally attained his RESEA review on March 27, 2026. As such, the claimant has met his RESEA obligations and will not be disqualified for this reason, even when the DUA’s temporary suspension is lifted.

The review examiner’s decision is affirmed in part and reversed in part. The claimant is denied benefits from February 1, 2026, through February 21, 2026. He is entitled to benefits as of the week ending February 28, 2026, and for subsequent weeks if otherwise eligible.
