H-2B temporary non-agricultural program

The H-2B program allows U.S. employers to hire workers from other countries for temporary non-agricultural work when there aren't enough American workers to fill the need.

Program requirements

Employers in Massachusetts must:

  • Be registered to conduct business in Massachusetts
  • Create an employer account on MassHire JobQuest, submit a Job order for review
  • Comply with federal guidelines to participate in the H-2B temporary non-agriculture program
  • Establish that the need is temporary (less than 9 months) 

If approved, a one-time need can last up to three years.

How and when to apply

The MassHire Department of Career Services (MDCS) Foreign Labor Certification (FLC) team helps employers complete the H-2B application process.

  1. Complete ETA Form 9141 Prevailing Wage Application and submit it to DOL Chicago National Prevailing Wage Center (CNPC) to receive a Prevailing Wage Determination. You can do this online in the FLAG system.
  2. When you get the Prevailing Wage Determination, but not more than 90 days before your employment need:
  3. 75 to 90 days before your employment need, update the H-2B Job Order in JobQuest with the CNPC case number and submit for review. 
  4. The Foreign Labor Certification (FLC) team will review the job order and report their findings to CNPC. CNPC will review the application and job order and notify you of their decision:
    • If your application is not accepted, you will get a Notice of Deficiency. You have 10 days to submit a Modified Application or Job Order to CNPC and MDCS.
    • If your application is accepted, follow the instructions in the notice, including guidelines for recruitment, submitting a recruitment report, and more.
