300 Days to File (Statute of Limitations)
IMPORTANT: You have 300 days from the last act of discrimination in employment, housing and public accommodations to file a complaint at the MCAD. You have six months from the last act of discrimination in education to file a complaint. Scheduling your intake interview does not pause the time limit to file a complaint.
If you are concerned that the 300 day statute of limitations may expire before you are able to schedule an intake, please call the MCAD and speak with the receptionist about scheduling an emergency intake due to the impending deadline.
What to Expect During the Intake Interview
You will receive a call from an MCAD Investigator at the date and time you scheduled your Intake Interview at the phone number you provided. Please note, the interview must begin, and end at the times identified. If the investigator requires additional information beyond what is provided during the call, they will follow up with you.
Please be aware that our staff may be working from home and you may receive a call from a blocked or unlisted number.
If you do not answer the phone after two attempts to reach you, the investigator will email you to inform you that you have missed the intake interview, and that you must book a new intake interview at a later date and time.
The intake interview is scheduled for approximately one hour.
Important: You must have access to your email during the intake interview. At the end of the interview, in order to file a Complaint, you must review the draft Complaint and reply to the investigator's email affirming that the information contained within the Complaint is a true and accurate account of the events that occurred to the best of your knowledge.
NOTICE: The filing process is not complete until you reply via email to the investigator. If you do not reply to the investigator's email within one business day, your Complaint will not be filed, and you may risk missing the deadline to file your Complaint, which may affect your rights to obtain a remedy or litigate these matters.
Preparing for the Intake Interview
Please prepare the following information for the intake. To ensure the requisite information is obtained during your call
We recommend that you write out a mini timeline of what happened in chronological order. If possible, please provide specific dates or periods of time when the discriminatory conduct occurred. Please also provide:
- The full names of the Respondents (The Business, Employer or Landlord and/or name of the person who you believe discriminated against you)including the correct mailing address of the company, and telephone number)
- The dates that the discriminatory conduct occurred.
- The names of any witnesses. Did you or someone else report the discriminatory conduct to anyone? If yes, who was told, what specifically was said when reporting the conduct, when was it reported, did the conduct continue after the report, and did anyone take any actions to address the discrimination?
- For claims related to a medical condition or disability, be prepared to tell us the specific diagnosis for your disability/condition. If you made a request for an accommodation related to the disability/condition, be prepared to tell us when the accommodation was requested, what specifically was said when requesting the accommodation, what response you received, whether the specific accommodation was granted, and whether a different accommodation was granted.
Rescheduling or Cancelling the Intake Interview
If you need to cancel or reschedule your intake interview, please click on the “reschedule/cancel” link in the Confirmation email or the Reminder email at least 2 business days before your scheduled Intake Interview appointment.
