TR 500.6 In Need of Training

0029 1195 45 (June 27, 2019) – Claimant, who decided not to attend an approved training program because she was pursuing a job, did not have good cause for filing a second Section 30 application after exhausting regular benefits without securing employment. Nor did she establish that her education and work experience in the field of marketing were inadequate to find work, or that her chosen aesthetician program was necessary for her to obtain suitable employment. Hearing examiner is not limited to the specific grounds for disqualification stated in the DUA determination.

0027 1858 66 (Mar. 20, 2019) – Claimant could begin training after her benefit year expired, because a Board decision reversing her disqualification from receiving regular unemployment benefits was issued only a month before the expiration date. The claimant established that she needs this graduate-level certificate in public health training to update her skills and education in order to obtain suitable work. During the semester that the claimant is enrolled full-time, she is eligible for Section 30 benefits.

0020 8648 94 (Nov. 9, 2017) – Under 430 CMR 9.04(1), the claimant has shown that she is unlikely to obtain suitable employment based on her most recently utilized skills and is in need of training to become re-employed. Her bachelor’s degree in the hospitality field is 22 years old, she spent the last 13 years in administrative and activity-related jobs in the healthcare field, and she lives in a rural part of the state, where suitable jobs are more scarce.
