0052 8999 53 (Oct. 28, 2022) – In response to the claimant’s complaint about a coworker making sexually harassing gestures in her office, the employer did initiate an investigation. However, the coworker’s conduct continued after the complaint, her supervisor openly discussed his doubts about the merits of the complaint in the office, and he engaged her in a conversation about the investigation in the presence of the coworker. Held the claimant had good cause attributable to the employer to resign and she is eligible for benefits pursuant to G.L. c. 151A, § 25(e)(1). In instances of alleged sexual harassment, claimants are not required to make reasonable efforts to preserve their employment.

0054 0210 01 (Mar. 29, 2022) – Where the employer told the claimant it would try to arrange a transfer to a different work location and the claimant quit his job that day, the claimant did not have good cause attributable to the employer to resign over its failure to transfer him. However, he did demonstrate that he had grounds for leaving his job due to a supervisor’s harassment within the meaning of 430 CMR 4.04(5)(c)(3), and he is eligible for benefits on that basis.

0002 5053 65 (Jan. 14, 2014) – Where coworker yelled at the claimant, threw papers at him, and stopped training him, the problem went beyond a personality conflict; the unprovoked behavior interfered with the claimant’s work. Claimant had good cause attributable to the employer to resign after raising the issue with his supervisor, the assistant vice president, the vice president, and human resources, and the coworker’s behavior did not change.
