Boston — Attorney General Andrea Joy Campbell issued the following statement in response to today’s ruling of the Supreme Court of the United States in Food and Drug Administration (FDA) v. Alliance for Hippocratic Medicine to uphold access to mifepristone, a historically safe, effective and FDA-approved form of medication abortion.
“I commend the Supreme Court for unanimously rejecting this lawsuit which is a right-wing, anti-science attack on the FDA and its approval of mifepristone. Mifepristone is safe, effective, and will continue to remain available as it always has been. But make no mistake: anti-abortion advocates will not stop trying to prevent Americans from accessing reproductive healthcare, including medication abortion. I am ready to take on these fights and will use every tool at my disposal to ensure continued access to abortion for all who need it,” said AG Campbell.
In 2023, AG Campbell joined a coalition of attorneys general in filing an amicus brief in the Supreme Court urging the Court to take up Food and Drug Administration v. Alliance for Hippocratic Medicine in order to reverse a Fifth Circuit decision that would have reinstated medically unnecessary restrictions on mifepristone.
In 2024, AG Campbell joined the same coalition in filing an amicus brief in the Supreme Court supporting the FDA’s efforts to reverse a ruling by the U.S. Court of Appeals for the Fifth Circuit that reinstated certain restrictions on mifepristone.
ON BACKGROUND:
- During an era of unprecedented national attacks on reproductive care, AG Campbell has continued to ensure Massachusetts remains a beacon for reproductive justice.
- As one of her first actions in office, AG Campbell, in collaboration with allied stakeholders, announced the creation of the Abortion Legal Hotline, a free and confidential hotline that assists Massachusetts healthcare providers, helpers, and patients, by providing legal advice and resources related to abortion access and care.
- AG Campbell has also established a Reproductive Justice Unit which is focused on expanding and protecting access to reproductive and gender affirming care, addressing disparities in maternal health, tackling misinformation and disinformation that prevents access to care, working across state lines to respond to national attacks on reproductive health care, and championing and defending Massachusetts’ strong legal protections for reproductive rights.
- Today’s decision unanimously concludes that the plaintiffs in the case lack standing to challenge the FDA’s regulation of mifepristone.
