Press Release  MassDEP Fines Leominster Contractor for Asbestos Violations in Harvard Home

BOSTON — The Massachusetts Department of Environmental Protection (MassDEP) has assessed a $46,980 penalty against Leominster-based D&R Environmental Services LLC (D&R), a licensed asbestos contractor, for multiple violations of the state’s asbestos regulations during work at a private residence in the Town of Harvard.

D&R was hired by a Harvard homeowner to remove asbestos-containing materials as part of a heating system abatement project on the property. After the company completed the work, the concerned and dissatisfied homeowner hired an independent asbestos consultant to assess the site. The consultant subsequently contacted MassDEP to report potential issues. During its investigation, MassDEP discovered that while D&R disposed of a heating pipe wrapped in asbestos insulation in accordance with state regulations, the company failed to follow required work practices during the removal and packaging of the pipe.

"Although D&R Environmental Services properly followed regulatory procedures for disposal, its mishandling and improper packaging of the asbestos materials beforehand was a serious violation that put public health and the environment at unnecessary risk," said Mary Jude Pigsley, director of MassDEP’s central regional office in Worcester. "Asbestos is a known carcinogen, and all asbestos-related abatement work must be done using strict procedures to prevent exposure and environmental contamination."

Under the terms of the consent order issued by MassDEP, D&R must pay the $46,980 penalty and comply with all requirements of the asbestos regulations — including all notices, submittals and other communications — while conducting demolition and/or renovation activities in Massachusetts.

MassDEP is responsible for ensuring clean air and water, safe management of solid and hazardous waste, timely cleanup of hazardous waste sites and spills, and the preservation of wetlands and coastal resources. Property owners or contractors with questions about asbestos-containing materials; notification requirements; proper removal, handling, packaging, storage, and disposal procedures; or the asbestos regulations are encouraged to contact the appropriate MassDEP Regional Office for assistance.
