BOSTON — The Massachusetts Department of Environmental Protection (MassDEP) has penalized Taylor Davis Landscaping Company, Inc. $42,412.50 for Hazardous Waste and Wetlands Protection regulation violations that occurred at its facility located at 71 West Pomeroy Lane in Amherst.
Taylor Davis Landscaping's violations included failing to notify MassDEP of a diesel fuel release, neglecting to conduct an appropriate response action for the release, engaging in activities that impaired a wetland, and improperly managing waste oil. The company cooperated with MassDEP throughout the investigation and took corrective actions, including the removal of approximately 35 tons of contaminated soil from the facility.
Under the terms of MassDEP's Consent Order, Taylor Davis Landscaping has agreed to pay a penalty of $30,000 and ensure that all violations cited in the order are corrected. MassDEP agreed to suspend the remaining $12,412.50 of the penalty provided the company complies with all the terms and requirements of the order.
"There were a multitude of violations at this facility that this enforcement action resolves,” said Michael Gorski, director of MassDEP’s Western Regional Office in Springfield. “MassDEP holds accountable those who don’t take reasonable steps to comply with the environmental regulations that protect people and the environment."
