Policy Statement  2014-01: Staff Action to Identify Individual Registration Applications requiring Good Moral Character evaluation

Purpose

The Board of Registration in Pharmacy adopts this policy to authorize Board staff to screen individual registration applications and identify those requiring evaluation by the full board to determine if the applicant meets the good moral character requirement for registration.

Definitions

Adverse History means:

  1. Disciplinary sanction(s) or non-disciplinary restriction(s) on an applicant’s professional license, registration or certification that is imposed by the issuing jurisdiction or agency either by order or by consent agreement between the jurisdiction or agency and the applicant;
  2. Complaint(s) or proceeding(s) against any professional license, registration or certification held by the applicant pending before the issuing jurisdiction or agency;
  3. Criminal conviction(s) against the applicant.
  4. Criminal investigation(s) or criminal proceeding(s) against the applicant that involve controlled substances; and/or
  5. Pending criminal investigation(s) or criminal proceeding(s) in relation to any violation.

Authorization to approve

The Board authorizes designated staff (“Board staff”) and third party applications processing agents to review applications for registration and to act on them as follows.

  1. Board staff and/or third party application processing agents shall review all applications submitted by an individual for registration as a pharmacist, nuclear pharmacist, pharmacy intern, and pharmacy technician to ascertain whether the applicant has disclosed, or Board staff otherwise possesses evidence of, adverse history.
  2. Where applicants disclose adverse history of any type, Board staff shall review additional criminal history accessible to the Board as a government licensing agency.
  3. Board staff shall identify whether an applicant’s adverse history includes any of the following:
    1. Adverse history involving a criminal proceeding that
      • i. does not involve controlled substances,
      • ii. is no longer pending, and
      • iii. did not result in a conviction;
    2. Adverse history involving a criminal proceeding that
      • i. is limited to a single event involving alcohol,
      • ii. occurred more than one year prior to the application, and
      • iii. is no longer pending.
    3. Adverse history has been previously reviewed by the full board where the licensee was determined to meet the Good Moral Character requirement.
  4. Board staff is authorized to proceed with issuing a registration and/or to instruct third party application processing agents to proceed with the application process in those instances where the adverse history is limited to the criteria identified in paragraph 3a, 3b, and 3c.
  5. Board staff shall bring all other applications where the applicant disclosed adverse history to the full board for review.
