Bribery Enforcement Matters (G.L. c. 268A, § 2)

G.L. c. 268A, § 2

1. Adamson, Randy Docket No. 07-0037
   Revere Sewer Foreman Randy Adamson paid an $8,000 civil penalty after admitting to violating §§ 2(a) and 17(a) of the conflict of interest law by performing private water and sewer work in the city and paying bribes to Water and Sewer Enterprise Fund General Manager Joseph Maglione to secure permits to do the work.

2. Charles Birchall, III Docket No. 11-0020
   Former Lawrence Public Schools Employee Charles Birchall III violated the conflict of interest law by accepting a bribe in exchange for issuing a fraudulent purchase order, and for using school department resources for a private printing job.  Birchall paid a $6,000 civil penalty and a $2,449 civil forfeiture.

3. Craven, Jr., James J. Docket No. 110
   State Representative James J. Craven, Jr. violated sections 6 and 23 of the conflict of interest law by using his position to pressure Executive Office of Communities and Development officials to provide state funding for a community development corporation, Jamaica Plain Community Development Foundation, founded by Craven's legislative aide, which rented space in a building owned by Rep. Craven's siblings. The Commission found that Rep. Craven did not violate section 2 in connection with this matter. Craven was ordered to pay a $1,000 civil penalty.

4. Edwards, Terry Docket No. 08-0006
   Former P.A. Landers project manager Terry Edwards paid a $5,000 civil penalty after admitting to violating  section 2(a) of the conflict of interest law by giving cash to Massachusetts Highway Department inspector Thomas Kennedy in exchange for the inspector's lenient inspections of the P.A. Landers' work and timely processing of the vendor's paperwork.

5. Giampa, Kelly Docket No. 06-0001
   Former Springfield Parking Authority Operations and Facilities Manager Kelly Giampa paid a $3,000 civil penalty for soliciting bribes for herself and a friend in early September 2003 from a contractor seeking work from the Authority.

6. Giannino, Anthony Docket No. 07-0038
   Revere Drain Department Foreman Anthony Giannino paid an $8,000 civil penalty after admitting to violating §§ 2(a) and 17(a) of the conflict of interest law by performing private water and sewer work in the city and paying bribes to Water and Sewer Enterprise Fund General Manager Joseph Maglione to secure permits to do the work.

7. Jovanovic, Michael Docket No. 625
   The Commission issued a Decision and Order concluding that Quincy resident Michael Jovanovic violated the state's conflict law by offering a bribe to a Department of Medical Assistance employee who was about to deny Jovanovic's application for financial assistance for his brother who was in a nursing home. Jovanovic was ordered to pay a $2,000 civil penalty.

8. Kennedy, Thomas Docket No. 08-0007
   The Commission issued a Decision and Order concluding that former MassHighway Inspector Thomas Kennedy violated section 2(b) of the conflict of interest law by soliciting and receiving bribes from a vendor in exchange for lenient inspections of the vendor's work and timely processing of the vendor's paperwork. Kennedy was ordered to pay a $6,000 civil penalty.

9. Laurenza, John Docket No. 12-0006
   Former Lawrence public school department employee John Laurenza paid a $4,000 civil penalty and $536.12 civil forfeiture after admitting to accepting money in a bid rigging arrangement with a vendor.

10. Maglione, Joseph Docket No. 07-0039
    The Commission issued a Decision and Order concluding that allegations that Revere Water and Sewer Enterprise Fund General Manager Joseph Maglione violated §§ 2(a) and 17(a) of the conflict of interest law by accepting bribes in exchange for permitting private water and sewer work
    were not proven by a preponderance of the evidence.

11. Nolan, Thomas H. Docket No. 361
    Chelsea Mayor Thomas Nolan was ordered to pay a $2,000 civil penalty after the Commission found he violated G.L. c. 268A, section 2 and section 3 by offering not to schedule a fire captains' promotional exam in exchange for the support of ten firefighters in his re-election campaign.

12. Scott, John F. Docket No. 08-0018
    The Commission issued a Decision and Order concluding that property developer John F. Scott violated G. L. c. 268A, section 3(a) by offering a free week's stay at his cabin to a municipal employee from whom he was seeking permits. The Commission found an allegation that Scott violated section 2(a) of the conflict of interest law was not proven by a preponderance of the evidence. Scott was ordered to pay a $2,000 civil penalty.

13. St. Germain, Matthew Docket No. 687
    Berkley septic installer Matthew St. Germain paid a $2,000 civil penalty after admitting to violating section 3(a) of the conflict of interest law by paying two Board of Health members $100 each for signing certificate of compliance.

14. Stanton, William J. Docket No. 440
    William J. Stanton, former manager of the Speaker of the House's business office, paid a $3,500 civil penalty after admitting to violating section 2 and section 3 of the conflict of interest law by accepting a bribe and several gifts from individuals with whom he had official dealings.

15. Sunskis, Algird Docket No. 13-0002
    The Ethics Commission issued a Ruling and Order of Dismissal granting a Joint Motion to Dismiss the Adjudicatory Proceeding involving Algird Sunskis.
