Impartial report

The impartial doctor writes a medical report and submits it to the administrative judge on the case.

Impartial reports

After the impartial doctor examines the employee, the department distributes the report to the parties at least 1 week prior to the beginning of the hearing. The report states the examiner's opinion as to whether or not a medical end result has been reached and what permanent impairments or losses of function exist, if any. Where practical, the report contains a determination of the following:

  1. whether or not a disability exists,

  2. whether or not any such disability is total or partial, and permanent or temporary, in nature, and
  3. whether or not, within a reasonable degree of medical certainty, any such disability has as its major or predominant contributing cause a personal injury arising out of, and in the course of, the employee's employment
