TR 500.3 Duration of Training Program

0002 1718 87 (June 8, 2015) – Claimant in a 3-year masters in nursing program was ineligible for Section 30 benefits, because he would not complete his studies within 2 years.  Even though the claimant would be eligible to become an R.N. and would, in fact, work part-time as a nurse after completing the first year and passing the standardized licensing examination, he would remain a full-time student rather than work full-time.

0012 3255 24 (Sept. 10, 2014) – Where a claimant can complete an associate’s or bachelor’s degree on a full-time basis within two years of filing a claim for benefits, the college is not required to meet the job placement rate requirement of 430 CMR 9.05(2)(a).  The Board held the claimant was eligible for extended benefits under G.L. c. 151A, § 30(c).

BR-102996 (April 23, 2007) – Although claimant did not qualify for G.L. c. 151A, § 30(c) training benefits, because her journalism program extended beyond the one-year cap under regulations in effect at the time, she remained eligible for regular unemployment benefits.  Her attendance at school did not render her unavailable for work.
