Changing a child support order. This video will show you how to change a child support order at the Probate and Family Court.
If you have already received a child support order or judgment and need to change it, you may need to file paperwork with the court.
Some reasons to change your order: There is a difference between the amount paid in child support and the amount that should be paid under Child Support Guidelines; Changes in either parent's ability to afford health insurance; Changes in income, employment, and/or a child's living arrangements.
You must request a change to your court order or judgment at the Probate and Family Court location that first entered the order or judgment. The court may contact you to opt-in to the "Pathways Case Management Initiative." This process uses a problem-solving approach to help you resolve your case, and it may reduce the time you spend in court.
If both parents agree to change the order or judgment, file a copy of the order or judgment along with the packet of required forms with the court.
You can learn more and find a checklist for your forms at mass.gov/how-to/file-changes-to-child-support-if-both-parties-agree-to-the-change.
If only one parent wants to change the order, you'll have to file the complaint on your own.
If the Department of Revenue (DOR) is involved in your case, they can help you change your order if there appears to be a legal reason for changing it.
File a "Complaint for Modification" if the court entered a judgment. File a motion if the court entered a temporary order.
