The Commission vacated the termination of a Section 8 coordinator from the Medford Housing Authority given that the City could not demonstrate that the Appellant’s whistleblower activities had caused the resignation of two other MHA employees or otherwise constituted misconduct.
The Commission dismissed the appeal of a Boston police officer who was discharged following an off-duty incident in which the officer's department-issued firearm was stolen after it was not properly secured and he gave a civilian access to his vehicle. The Commission was not convinced by the police officer’s argument.
The Commission found that it lacked jurisdiction to hear the appeal of a City of Waltham Public Health Nurse who was given a three-day suspension since his appointment was a provisional one.
The Commission upheld the discharge of a Correction Officer at MCI Shirley who showed a disregard for the basic responsibilities of his duty and engaged in inappropriate discussions with his brother and other inmates at the Worcester County House of Corrections and failing to notify DOC he had been charged with A&B.
The Commission affirmed the 20-day suspension of a long-serving Lowell fire lieutenant who refused to serve shifts on the back step of a ladder truck and went on to undermine the chain of command when attempting to avoid the assignment. The Commission found this to be conduct unbecoming of a firefighter.
The Commission modified the discharge of a Leominster Police Department officer to a 60-day suspension, given that implicit bias affected Leominster’s treatment of his case. The Commission also found it concerning that Leominster came to a baseless conclusion that the police officer almost assaulted his superior.
