The Commission denied the appeal from a Gloucester Deputy Fire Chief who received a 22-hour suspension over a discourteous email where insubordination was listed as a major offense in the Department’s Standard Operation Guidelines and the Chief was not required to apply progressive principles.

A majority of the Commission allowed the examination appeal of a Brockton Police Lieutenant, concluding that, under the specific facts of this case, the Appellant’s time as a UMass Lowell police officer should be properly credited toward determining his eligibility for a 2-point, 25-year preference.

The Commission approved a joint request for relief based on the unique circumstances related to these appeals.

After providing two former Holbrook firefighters with repeated opportunities to exercise their due process appeal rights, the Commission dismissed their appeals based on their failure to prosecute their appeals, including failing to appear for scheduled hearings without good cause.

The Commission allowed the reclassification appeal of an EDP Computer Operations Supervisor in the Department of Revenue as the Appellant was able to demonstrate that she spent the majority of her time performing the duties and responsibilities of the desired classification, Program Coordinator III.
