The Commission denied the Appellant’s request to reconsider its decision to affirm the decision of the City of Chelsea to suspend the Appellant and demote him from Fire Captain to Firefighter as he failed to identify a clerical or mechanical error in the decision or a significant factor the Commission overlooked.

The Commission upheld the six-month suspension and demotion of a Fire Captain to Firefighter, finding that the Appellant’s persistent pattern of attendance issues, culminating in an unjustified refusal to return to work, even on limited duty, justified the discipline imposed.

Bypass; original appointment; firefighter; appeal allowed.

Appellant does not perform the duties of General Construction Inspector II a majority of the time. Duties performed during voluntary overtime do not count toward calculation.

The Commission dismissed the appeal of Avon Police Officer regarding the incorrect submission of an E&E claim given that HRD instructions on how to properly submit are very clear and that HRD provides significant reminders.
