The Commission reversed the discharge of an East Longmeadow Police Officer given that the officer had not been untruthful in relation to an altercation in response to an incident at a local business, had no disciplinary history, and video evidence of the incident which was not incriminating.

Education and experience examination appeal allowed. HRD's decision to not grant the Appellant credit for 1714 hours as a temporary fire lieutenant was arbitrary and capricious and not consistent with basic merit principles.

Appellants' non-bypass equity appeals denied. Arbitrator's decision to provide a reinstated employee time to take make-up examination was not inconsistent with the civil service law.

The Commission dismissed nisi an appeal of a Winthrop police officer seeking a promotional appointment to sergeant given the position was already filled and the Superior Court had already intervened, providing the individual in the position $2 million in compensation and 6 months to study for the promotional exam.

The Civil Service Commission allowed the Appellant’s bypass appeal and ordered that he receive one additional consideration for appointment as a permanent, full-time police officer based on the City’s failure to conduct a thorough review of his candidacy
