For multiple reasons cited in this decision, the City of Newton was unable to establish by a preponderance of the evidence that the positive results of a hair drug test, which, unlike urine drug testing, has not been approved by federal regulators, was conclusive of ingestion of an illegal drug, the reason for bypass.

The Commission allowed the bypass appeal of a candidate seeking appointment to the Lowell Police Department given that Lowell Police Department wrongfully relied on the candidate's payment-default license suspension and failed to consider the candidate's positive driving record in the National Guard.
