Matter involved violations state laws and regulations addressing inspection by the Massachusetts Environmental Police, commercial and recreational fishing limits,  the possession of undersized fish, and permitting requirements. This included: (1) failure to display fish on demand; (2) possession of black sea bass in excess of the recreational limit; (3) possession of black sea bass during a recreational closed season; (4) possession of black sea bass in excess of the commercial limit; (5) possession of black sea bass during a commercial closed season; (6) possession of undersized black sea bass; (7) possession of undersized tautog; and (8) recreationally fishing without a valid Recreational Saltwater Fishing Permit. Baptista did not exercise right to hearing and Final Decision was issued based on summary judgement. Claimant obtained a revocation of Baptista's Commercial Boat Permit and all appurtenant regulated fishery permit endorsements.
