Matter addressed violations of state's shellfish sanitation rules necessary to safeguard public health. This included: (1) the harvest, possession, and sale of shellfish taken from a contaminated shellfish growing area closed to shellfish fishing; and (2)  possession and sale of shellfish without a complete and accurate shellfish harvester tag affixed to each container of shellfish. The Respondent did not appear at the adjudicatory hearing and a default judgement was entered. The Final Agency Action resulted in the permanent revocation of Whitmore's Commercial Shellfish Permit and Transaction Card.
