Matter involved violations of the state's  laws and regulations addressing inspection by the Massachusetts Environmental Police, recreational fishing limits and requirements for a charter boat. This included: (1) failure to display the charter boat permit; (2) possession of black sea bass in excess of recreational fishing limits; (3) possession of black sea bass during a closed season; (4) possession of undersized black sea bass; (5) failure to post or notify charter boat patrons of recreational fishing limits for target species; and (6) failure to provide visible and accessible measuring devices on a charter boat. Final Agency Action resulted in the permanent revocation of Botelho's Charter Boat Permit.
