Matter involved violations of state's sanitation rules necessary to safeguard public heath and permitting requirements. This included: (1) taking of shellfish from a contaminated shellfish growing area closed to harvest; (2) possession and transport of shellfish without a complete and accurate shellfish harvester tag affixed to each container of shellfish; (3) unauthorized wet storage of shellfish; and (4) failure to comply with statement of permit conditions. Final Agency Action resulted in the permanent revocation of Richard Luce's Commercial Shellfish Permit, Transaction Card, and Shellfish Propagation Permit and Gregory Luce's Commercial Shellfish Permit and Transaction Card.
