In accordance with the provisions of G. L. c. 30A, §20, and Chapter 2 of the Acts of 2025, notice is hereby given that a hybrid meeting of the Board of Elevator Regulations will be held on Tuesday, April 28, 2026, at 1:00 p.m.

Agenda

It is anticipated that the topics shown below will be discussed at the aforementioned meeting: 

  1. Roll Call.
  2. Closed Session, closed pursuant to G. L. c. 30A, § 18, ¶ 5(d), for the purpose of conducting an adjudicatory conference in the matter of VAR25-0085 and VAR25-0086.

    The petitioner is back before the board after being in front of the board on February 3, 2026, when the board voted to place the item on hold for no more than 60 days, which was a deadline of April 4, 2026, for the petitioner to provide documentation to  address the attendant operation and controls with AAB and all applicable codes. The petitioner provided a memo dated April 3, 2026, addressed to the Board of Elevator Regulations. 

    The petitioner was before board on December 2, 2025, August 26, 2025, June 3, 2025, and March 4, 2025, seeking a variance from ASME A18.1 2014 section 3.1.2.2 for overhead clearance to install new lift to replace the existing lift.  The board had requested documentation to support the low overhead including structural drawings and to present a solution to meet safety.

      The petitioner was before the board on April 7, 2026, and the board voted to defer the case to a future Quasi-Judicial Closed Session for additional review. 

      The petitioner is back before the board after previously being before the board on January 27, 2026, when the board voted to place the item on a 60-day hold, which provided a deadline of March 28, 2026. The applicant was requested to  gather more information including pit dimensions, plan view, equipment information and demonstration of hardship.  New documentation submitted March 27, 2026, included two design drawings and a photograph. 

      The petitioner was seeking a safety-equivalent variance from 524 CMR - A17.1 – 2013 Section 2.2.4.2 regarding the ladder installation for units 293-P-285 and 293-P-286.

      The petitioner was before the board on April 7, 2026, and the board voted to place the item on a 60-day hold, which provided a deadline of June 8, 2026, for the applicant to gather evidence proving the battery lower is not required by any other applicable codes.

      The petitioner is seeking relief from 524 CMR 8.06 by requesting permission to remove the battery lowering unit from this elevator.
