In accordance with the provisions of G. L. c. 30A, §20, and Chapter 2 of the Acts of 2025, notice is hereby given that a hybrid meeting of the Board of Elevator Regulations will be held on Tuesday, June 23, 2026, at 1:00 p.m.

It is anticipated that the topics shown below will be discussed at the aforementioned meeting:

   220 State Street Springfield

   Code Reference: 524 CMR 8.06

   Petitioner: Christine Parnell

The petitioner is back before the board after being before the board on April 7, 2026, and the board voted to place the item on a 60-day hold, which provided a deadline of June 8, 2026, for the applicant to gather evidence proving the battery lower is not required by any other applicable codes. The petitioner supplied supporting written documentation.

The petitioner is seeking relief from 524 CMR 8.06 by requesting permission to remove the battery lowering unit from this elevator.

   Code Reference: 524 CMR 35.00/ASME A17.1-2013 Section 2.7

   Petitioner: John Murphy

   The petitioner is seeking a variance from 524 CMR 35.00/ASME A17.1-2013 Section 2.7 regarding one part of the room where there is an existing structural beam.

   Petitioner: William Griffin

   The petitioner is seeking a variance from 524 CMR 5.2.1.4.1 to increase the approved pit depth from 14" to 16" and to permit the use of an alternative means of achieving bottom car clearance in accordance with ASME A17.1–2013 Section 5.2.1.4.2 for the installed Garaventa Elvoron LULA elevator and from 524 CMR (ASME A17.1–2013) Section 5.2.1.16.5, Maximum Rise, to allow a Garaventa Elvoron Slide LULA elevator with a maximum rise of 312.5 inches (26 feet, 0.5 inches).

   Code Reference: ASME A17.1-2013 section 2.5.4 (b) 

   Petitioner: Christen Parsens

   The petitioner is seeking a variance from ASME A17.1-2013 section 2.5.4 (b) to allow the notch in the car sill to exceed the max of 1.25" dimension to keep the current dimension of 2.5”.

6. Submission of email comments/suggestions from May 6, 2026, Board of Regulations Public Hearing to review and discuss at a future meeting.
7. Variance Administrative Decisions processed. VAR26-0032, VAR26-0033, and VAR26-0038 with State IDs 348-P-1496, 348-P-1497,  and 348-P-1495 at the address of 629 Salisbury Street Worcester. 
8. Mandatory notification from Elevator Inspector Joseph Janis, EM-005665, of an inspection INS-805304, for State ID 281-P-489, which was cited, pursuant to 524 CMR 1.13(7), for safety issues, specifically there being a hole in the floor for access to a sub secondary machine space below the elevator machine room with a  ladder going down into the hole, but no handles are provided. Inspector Janis informed them that he is requiring handles be installed for safe ladder access down into the sub machine space, pursuant to 524 Code Mass. Regs. § 1.13(2).

       Petitioner: Thomas McCarthy

After a Quasi-Judicial Closed Session was held on April 28, 2026, the board requested that a new solution be proposed within a deadline of no more than sixty days which is June 29, 2026, keeping within the following specifications and guidelines:

• accept a modification necessary to install a code compliant 9-inch ladder adjacent to the elevator guide rail and
• installation of a secondary pit mounted stop switch adjacent to the elevator guide rail.

The petitioner was before the board on April 7, 2026, and the board voted to defer the case to a future Quasi-Judicial Closed Session for additional review. 

The petitioner is back before the board after previously being before the board on January 27, 2026, when the board voted to place the item on a 60-day hold, which provided a deadline of March 28, 2026. The applicant was requested to  gather more information including pit dimensions, plan view, equipment information and demonstration of hardship.  New documentation submitted March 27, 2026, included two design drawings and a photograph. 

The petitioner was seeking a safety-equivalent variance from 524 CMR - A17.1 – 2013 Section 2.2.4.2 regarding the ladder installation for units 293-P-285 and 293-P-286.
