In accordance with the provisions of G. L. c. 30A, §20, and Chapter 2 of the Acts of 2025, notice is hereby given that a hybrid meeting of the Board of Elevator Regulations will be held on Tuesday, September 22, 2026, at 1:00 p.m.

It is anticipated that the topics shown below will be discussed at the aforementioned meeting: 

1. Roll Call.
2. Review Meeting Minutes of April 28, 2026, meeting.
3. Board discussion to verify starting times for October public hearing and board meeting of the same date, which have previously been held from noon to 12:30 pm and then 1:00 pm to 4:00 pm concurrently.

   Petitioner: Dan Lockwood

   The petitioner is seeking relief from 524 CMR 17.35 requesting a variance as this is a private residential building, there is equivalent safety provided, and compliance would be undue hardship.

   Petitioner: Cory Hussey

   The petitioner is seeking relief from 524 CMR 17.06 - Pipes and Wiring to allow the MI cable to run through the elevator shaft to the machine room. NEC NFPA 70 620.21 allows, by special permission, the installation of the main line feeders in the hoistway.

   New Product Approval

   LUMA – Savaria Residential Lift

   Code Reference: 524 CMR chapter 35 sections 5.3.1.1 & 5.3.1.1.1

   Petitioner: Bill Richardson

   The petitioner is back before the board after previously being before the board on August 25, 2026, in which the board voted to place the item on a 60-day hold, which provided a deadline of October 24, 2026, for the applicant to review code compliance and amend the variance request as needed. 

   The petitioner has submitted a modified variance request seeking a variance from 524 CMR chapter 35 section 5.3.1.1; to allow for the installation with no machine room as the machine and control space is on top of the elevator and section 5.3.1.1.1; to allow for the hoistway to be omitted as per original language of ASME A17.1 part 5.3.1.1.1., for the LUMA – Savaria Residential Lift.

The petitioner was before the board on July 7, 2026, and the board voted to place the item on a 120-day hold, which provided a deadline of November 4, 2026, for the applicant to investigate additional options for code compliance or provide documentation showing the scope of hardship. 

The petitioner is seeking a variance from ASME A17.1-2013 Section 6.1.3.6.4 - Safety Zone in which they are proposing a solution for the deficiency.
