Overview   of Public Comment Period for Proposed EDIP Regulations

Notice is hereby given pursuant to Massachusetts General Laws chapter 30A, section 2 that the Economic Assistance Coordinating Council (“EACC”) is proposing revisions to the regulations at 402 CMR 2.00 entitled “Economic Development Incentive Program (EDIP).”  The EACC is authorized to promulgate these regulations by clause (i) of subsection (b) of section 3B of chapter 23A of the General Laws. 

The revisions to 402 CMR 2.00 are intended to make the EDIP regulations consistent with changes to sections 3A to 3F of chapter 23A of the General Laws (the “EDIP Statute”).  The EDIP Statute has been amended several times since the last update to 402 CMR 2.00.  The most recent amendments to the EDIP Statute are set forth in section 7 of Chapter 219 of the Acts of 2016.

Proposed EDIP regulations

The proposed regulations also will implement the tax increment financing statute at section 59 of chapter 40 of the General Laws (the “TIF Statute”).  The Department of Housing and Community Development (“DHCD”) previously was authorized to promulgate regulations implementing the TIF Statute.  DHCD’s regulations are at 760 CMR 22.00.  Currently the EACC is authorized by clause (vii) of said section 59 of said chapter 40 to promulgate the TIF statute regulations.  DHCD has proposed to repeal the old TIF regulations at 760 CMR 22.00
