This petition may be filed by a union seeking to represent employees, employees seeking to decertify a union, or an employer seeking to determine the appropriate bargaining representative.

The Details   of File a representation or decertification petition

What you need   for File a representation or decertification petition

Petitioners filing representation and decertification petitions are required to file a showing of interest as follows:

  • A petitioner seeking to represent a proposed bargaining unit of employees who are not currently represented must submit a showing of interest of 30%
  • A petitioner seeking to represent a proposed bargaining unit of employees who are currently represented must submit a showing of interest of 50%
  • A petitioner seeking to decertify the incumbent union must submit a showing of interest of 50%
  • A showing of interest may not be filed electronically or by fax

How to file   File a representation or decertification petition

  1. Fill out the form
  2. Electronically sign the form and the certificate of service
  3. Follow the instructions to electronically submit a copy to the employer representative or the union representative
  4. Follow the instructions to electronically submit a copy to the DLR
  5. Mail or hand-deliver the original showing of interest to the DLR at Lafayette City Center, 2 Avenue de Lafayette, Boston, MA 02111-1750
