What are public projects and what are the signature requirements for public project evaluations?.

What are Public Projects?

Before we can determine the signature requirements, we must first define what a public project is.  Public projects are vertical building construction projects procured by Massachusetts state agencies, state commissions or authorities, state schools, state hospitals and municipalities. Out of state projects are not public. Federal projects are not public.

Public projects are bid under M.G.L. Chapters 149 and 149A. They require a DCAMM Certificate of Eligibility.  If a general contractor directly hires a sub-contractor to work on what otherwise appears to be a public project, it is not considered a public project if the sub-contractor did not bid directly to the Public Awarding Authority.  Public projects require that the contractor be hired directly by the Public Awarding Authority after the statutory bidding process is complete.

 Who Must Sign off on a Public Project Evaluation?

All public projects require a signature from someone from the Public Awarding Authority – no exceptions. For projects under1.5 million dollars ($1,500,000), the Public Awarding Authority may have an OPM, Architect or other party responsible for the oversight of the project complete the evaluation and sign it, but it still must be signed off on by the Public Awarding Authority.

For projects 1.5 million dollars ($1,500,000) and above, the Public Awarding Authority must have their OPM complete the evaluation and sign it.  The Public Awarding Authority must also sign off on the public evaluation as well for it to be valid.
