How the public input process for HCBS waiver renewal and amendment applications work

Home- and Community- Based Services (HCBS) waivers are typically approved for a five-year period. They must then be renewed with the federal Centers for Medicare & Medicaid Services (CMS). During the five-year period, changes must be submitted to CMS in the form of a Request for an Amendment. This webpage contains information about waivers MassHealth is currently renewing and/or amending with CMS. Overview

MassHealth and the Department of Developmental Services (DDS) jointly propose an amendment to the Intensive Supports Waiver, Community Living Waiver, and Adult Supports Waiver. The proposed amendment removes the Day Habilitation Supplement service from the three ID waivers. The state is transitioning the Day Habilitation Supplement service to a component of the Day Habilitation (DH) state plan service to provide a more streamlined and structured service for members and DH providers. The updated process will also make the service easier to access and administer and will make the service available to all eligible MassHealth members, not only those enrolled in one of the DDS Adult ID waivers. MassHealth and DDS are working collaboratively to transition the Day Habilitation Supplement service, renamed Individualized Staffing Supports (ISS), from the Intensive Supports Waiver, Community Living Waiver, and Adult Supports Waiver to the state plan. MassHealth and DDS have worked closely on policies and procedures to ensure that current recipients of Day Habilitation Supplement will continue to receive the service in the same amount and duration through this transition.

Overview

MassHealth and the Massachusetts Rehabilitation Commission (MRC) jointly propose an amendment to the Traumatic Brain Injury Waiver. The purpose of this amendment is to address certain needs of the population served by this waiver that were identified population- and system-wide during the COVID-19 emergency, and that are anticipated to continue beyond the public health emergency. This amendment expands the scope of the existing Specialized Medical Equipment waiver service to cover assistive technology devices that enable the individual to engage in waiver services and service planning remotely/via telehealth if necessary, expands the scope of the existing Transitional Assistance waiver service to cover assistive technology devices that enable the individual to participate in planning their transition remotely/via telehealth if necessary, and increases flexibility for certain waiver related administrative activities to occur remotely/via telehealth. The amendment also contains changes to align with long-term goals of expanding access to certain brain injury-specific day services for waiver participants by revising the existing waiver service, Day Services, by adding a new provider type, updating the service definition, and adding new rates.  Additional changes include updating the Adult Companion and Individual Support and Community Habilitation provider qualifications to align with current procurement processes and adding a new rate regulation for Individual Support and Community Habilitation.

Overview

MassHealth and the Executive Office of Elder Affairs (EOEA) jointly propose an amendment to the Frail Elder Waiver. The purpose of this amendment is to address certain needs of the population served by this waiver that were identified population- and system-wide during the COVID-19 emergency, and that are anticipated to continue beyond the public health emergency. This amendment adds Assistive Technology for Telehealth Delivery of Waiver Services as a waiver service to cover devices that enable participants to engage in waiver services, expands the scope and renames the existing Cellular Personal Emergency Response System waiver service to cover devices that enable participants to interact and communicate remotely, and expands the scope of the existing Transitional Assistance waiver service to cover assistive technology devices that enable the individual to participate in planning their transition remotely/via telehealth if necessary. The proposed amendment also includes other technical changes to increase flexibility for service planning and case management to occur remotely/via telehealth by removing some references to specific modalities (i.e., “in person”, “telephone”) while maintaining operational integrity and removes transportation from the Companion service definition.
