Application for Approval of an Action to Increase Over the Present Rate of Interbasin Transfer
The Massachusetts Environmental Policy Act (MEPA) regulations (301 CMR 11.03) require a project proponent to file an Environmental Impact Report (EIR) for all Interbasin Transfer applications of 1 mgd or greater, or transfers that are not otherwise considered to be Insignificant by the Massachusetts Water Resources Commission (WRC). The EIR serves as the Interbasin Transfer Act application in these cases.
Please contact WRC staff for a project scope if you are proposing a project that will result in the transfer of water or wastewater across both a municipal boundary and a basin boundary. Interbasin Transfer project scopes specify the form, content, and level of detail of information to be included in the EIR, following each criterion of the Interbasin Transfer Act regulations. The Interbasin Transfer Act Performance Standards (used to evaluate compliance) provide additional detail on how the WRC makes its decision under the Act. If you are unsure if the Act applies to your project, please contact WRC staff for assistance.
