Note: this chart demonstrates a typical administrative appeal under General Laws chapter 30A. Not all appeals will follow this exact process.
Administrative appeals flowchart (text version)
Step 1: Administrative agency (defendant) sends notice of final decision
- Within 30 days, proceed to Step 2
Step 2: The person appealing (plaintiff) files the complaint and civil action cover sheet
- Within 90 days, proceed to Step 3
Step 3: The plaintiff serves the complaint on agency and any other defendants
Option 1: The defendant sends notice on how to request a transcript
- If necessary, the plaintiff requests a transcript within 30 days
- The plaintiff then sends the transcript to the defendant
- The defendant files record
- If necessary, the following preliminary motions are filed by either party within 20 days: Mass. R. Civ. P. 12(b), 12(e); G.L c. 30A, §§ 14(5) & 14(6)
Option 2: The defendant files record within 90 days
- Next, within 30 days, the plaintiff sends a 12(c) motion to the defendant
- Then, within the following 30 days, the defendant sends the plaintiff a 12(c) response
- The plaintiff then files a 9A packet
- Lastly, a court hearing takes place
