Office of Adult Guardianship and Conservatorship Oversight (OAGCO) Monitoring

Learn about how the OAGCO monitors guardians and conservators of adults.

Massachusetts law requires that guardians and conservators of adults file annual reports with the Court.

The OAGCO monitors these reports across all 14 Divisions of the Probate and Family Court through tracking, notifying, and reviewing.

Tracking

Each month, the OAGCO tracks if guardians of adults have filed their annual Guardian’s Care Plan Report and if conservators of adults have filed their annual Account. 

Notifying

If the Guardian’s Care Plan Report or the Account is more than 30 days past due, the OAGCO issues a Notice of Noncompliance to the guardian or conservator. It also notifies the Division in which the case is pending that the Notice has been sent.

If the guardian or conservator fails to file their overdue report by the date stated in the Notice, the OAGCO notifies the Division of the continued noncompliance. 

Reviewing

Each month, the OAGCO reviews filed Guardian’s Care Plan Reports. The Guardian’s Care Plan Report tells the Court how the adult under guardianship is doing and how the guardian is performing their duties. The OAGCO notifies the guardian and the Division of the results of their review and reminds the guardian of their next report due date.
