State-owned Farmland Licensing Program FAQ

Frequently Asked Questions

Suppose at the end of my five-year agreement I want to continue participation. Is that possible?
Yes. Your license will come with a renewal option.

The Program sounds intriguing to me, but I'm just not sure I can commit to a five-year agreement. Is there any way to get a shorter agreement?
Yes. When the Department sees that a five-year agreement won't work for you, a one-year special permit may be granted.

I live in a neighboring state. Can I participate in the program?
Sorry! The Program is open to Commonwealth residents only.

If I were to be granted a license, what kind of structures can I put on the land?
Temporary structures like high tunnels, fences, and movable sheds would need to be approved by the department before installation. Any significant infrastructural changes require approval by the department.

Could I sell the produce from enrolled land at a stand on that property?
These lands are intended solely for agricultural use, not for establishing retail operations or residential dwellings. Farmers are encouraged to sell through local markets, wholesale avenues, or farm stands off site.

Is there water on site?
Currently there is no existing irrigation infrastructure on the properties. Projects are underway during the 2024 season to provide irrigation sources (wells, surface water pumps) at selected properties.

Can the department license properties on the behalf of cities or towns?
Yes. If municipalities are willing to enter an agreement with the department, agricultural licenses can be granted for municipally owned land. The department can also provide technical assistance for municipalities seeking to develop their own agreements. Public officials should reach out to the department directly if opportunities arise for these types of agreements.
