BostonAttorney General Andrea Joy Campbell announced today that the Barnstable County Grand Jury has returned indictments against a Falmouth dentist and dental practice for submitting nearly $200,000 in false claims to MassHealth for services that were not provided and/or for services that were required to be performed by a dentist but were not.  

Dr. Marcus Swann, 49, of Falmouth, and his practice, Direct Pay Dental, of Falmouth, are each charged with four counts of Medicaid False Claims, G.L. c. 118E, § 40, and Larceny Over $1,200, G.L. c. 266, § 30. 

“I am proud of the team’s continued efforts to protect the integrity of the MassHealth program and our taxpayer resources, all while ensuring our residents receive the highest quality healthcare, including dental care and services,” said AG Campbell. “My office will continue to hold accountable those that violate the requirements and provisions of MassHealth.” 

The indictments allege that, from May 10, 2017 through August 24, 2022, Swann and Direct Pay Dental billed MassHealth for procedures that were performed by dental hygienists or dental assistants, including patient exams and crowns, even though those services are required to be performed by a licensed dentist. The indictments also allege that, from May 10, 2017 through December 31, 2020, Swann and Direct Pay Dental billed MassHealth for dental services that were not provided.    

All of the charges are allegations, and the defendants are presumed innocent until proven guilty.   

This matter is being handled by Assistant Attorney General William Champlin IV, Senior Healthcare Fraud Investigator Heather Dwyer, and Investigator Grace Bentley, all of AG Campbell’s Medicaid Fraud Division, as well as the Massachusetts State Police assigned to the AG’s Office. MassHealth provided substantial assistance with this investigation.  

The Massachusetts Medicaid Fraud Division receives 75 percent of its funding from the U.S. Department of Health and Human Services under a grant award totaling $5,865,996 for federal fiscal year 2024. The remaining 25 percent, totaling $1,955,330 for FY 2024, is funded by the Commonwealth of Massachusetts.  

This matter is AG Campbell’s latest effort to further her recently announced strategic priorities to advance opportunity for all across the Commonwealth, particularly through promoting health and safety throughout our state, fostering health equity by ensuring that MassHealth patients obtain the same level of care as all other patients, and holding to account those who misuse roles of authority or public trust.
