News  Berkshire District Attorney’s Office Obtains Lengthy Prison Sentence for Shooter of Nick Carnevale

PITTSFIELD — Judge Maureen Hogan sentenced Luis Delvalle-Rodriguez to serve 25 to 30 years in state prison and five years of probation afterward for shooting Nicholas Carnevale on Aug. 21, 2018 at a party at the Ashley Reservoir on October Mountain.

After a three-week jury trial, a Berkshire Superior Court Jury found the 27-year-old Delvalle-Rodriguez guilty last week of armed assault with intent to murder, assault and battery with a dangerous weapon causing serious bodily injury, assault and battery with a dangerous weapon, armed kidnapping with serious bodily injury, two counts of armed kidnapping, two counts of assault and battery, and malicious damage to a motor vehicle.

At sentencing on Wednesday, the Commonwealth requested a sentence of 30 to 35 years. The Defense Counsel requested a sentence of 10 to 12 years plus five years of probation.

“My office will continue to prosecute those who commit violence in our community aggressively. This is a tragic outcome for all parties involved but this lengthy sentence holds Mr. Delvalle-Rodriguez accountable for his actions and sends a message to our community that we will not tolerate gun violence,” District Attorney Andrea Harrington said.

“I am thankful Nick continues to progress in his recovery, and I wish him and his family the absolute best moving forward.”

Delvalle-Rodriguez nearly killed Carnevale when he shot him twice during an attack in which Delvalle-Rodriguez and others pulled Carnevale from his vehicle, then assaulted and shot him. The Berkshire District Attorney’s Office obtained convictions in the cases against co-defendants Kevin Nieves and Daquan Douglas for their roles. The court initially sentenced Nieves to 20 to 25 years in State Prison but is expected to increase that sentence in accordance with the Commonwealth’s arguments and the court sentenced Douglas to serve up to four years on a single count of misleading a police officer.

The Berkshire State Police Detective Unit assigned to the Berkshire District Attorney’s Office, the Massachusetts State Police Crime Scene Services and Ballistics Sections, forensic scientists assigned to the State Police Crime Laboratory, state troopers from the Lee and Cheshire barracks, members of the Pittsfield, Dalton, Washington and Hinsdale Police Departments and the Berkshire County Sheriff’s Department all participated in the investigation.
