Lynn, Massachusetts — James Woodbury, 44, 10 Fortesque Terrace, Lynn was arraigned today in Lynn District Court for murder after his 55-year old girlfriend, Donna Cucinotta, was found dead on Sunday evening in their apartment. Judge Dunbar Livingston ordered him held without bail and entered a plea of not guilty on his behalf.
Essex Assistant District Attorney Maria Markos told the court that at 10:44 p.m. on November 8th, Lynn Police received a request from a third-party to conduct a well-being check of the victim. The defendant had allegedly made statements to the third-party which made her concerned for the victim’s well-being. Upon arrival, Lynn Police could see the victim lying motionless on the floor and unresponsive to requests to open the door. After forcing entry, police determined that the victim was deceased and found the defendant in the back bedroom watching television.
The defendant is represented by Attorney Rebecca Whitehill and is presumed innocent until proven guilty. A probable cause hearing is scheduled for December 8, 2015.
